BOOKING TERMS & CONDITIONS



1) CONTRACT:

This contract is between the client and the company Etosha Fly-In Safaris cc

2) DEFINITIONS:

Booking: A reservation which is done by the client or the client's travel agency.

Client: (a) The person who accepts the booking, on behalf of himself, and persons under his authority if such booking is not done through a travel agency, which means that all are bound by the booking conditions as if they had individually made the applications themselves.

(b) The travel agency who places or accepts a booking for any person or group of persons or company with Etosha Fly-In Safaris cc

3. PAYMENT:

A deposit equal to 25% of the tour price per person is due once the booking has been confirmed in writing. Of this amount N$ 500.00 per person are non-refundable. The balance has to be paid 30 days prior to departure. Bookings made within 30 days of departure have to be paid in full upon receipt of confirmation. Documents will be released only upon full payment.

4) CANCELLATIONS:

Cancellations must be made in writing. Upon receipt of the written notification the following charges apply:

Up to 31 days prior to departure: Deposit forfeited

30 to 15 days prior to departure: 50% of total tour price forfeited

14 to 8 days prior to departure: 75% of total tour price forfeited

7 days or less prior to departure: 100% of total tour price forfeited

Please note, that if the reason for cancellation falls within the terms of any holiday insurance clients hold, then any such charges would normally be refunded to the clients by the insurance company, subject to the terms of the insurance.

5) TOUR PRICE:

Current tour prices as listed in the brochure are subject to alteration without prior notice. Prices could be adjusted due to variations in the rate of exchange, VAT or fuel price increases.

6) DELAYS AND CHANGES BY THE COMPANY:

The company shall reserve the right to change any tour due to unforseen circumstances (e.g. airlines not running on scheduled, road conditions, weather, mechanical breakdown, accidents and political instability) beyond the control of Etosha Fly-In Safaris cc. The company will try to provide an adequate alternative, but will accept no liability whatsoever,

BY THE CLIENT:

In case the client changes his itinerary on his own request, the company shall try to accommodate him, but may charge up to the above mentioned cancellation fees. This is subject to a new quotation, which will be given by the company to the client in writing.

7) AUTHORITY ON TOUR:

At all times, the decision of the tour guide/pilot will be final on all matters likely to endanger the safety and well being of the passengers. The clients must at all times strictly comply with laws, customs and foreign exchange regulations of all the countries visited. Should the client be detected in any contravention of the law, customs or foreign exchange regulations, or should the client be a nuisance, the guide/pilot may order the client to leave the tour without the right to refund.

The client shall be obliged to make his own way home at his expense and responsibility. Etosha Fly-In Safaris cc cannot and shall not be held responsible whatsoever.

8) ACCIDENTS:

while every precaution is taken to ensure the safety of all persons participating in the tour, the client, his/her heirs, dependants, agents, executors or their assignees, hereby irrevocably waive any rights which they may have to claim any form of compensation for any damages which they may suffer due to injury or death during, or at any time after the tour, from Etosha Fly-In Safaris cc Under no circumstances will Etosha Fly-In Safaris cc be responsible for death or any injury or loss which might occur to such persons sustained from any cause whatsoever. The client hereby indemnifies and holds Etosha Fly-In Safaris and its Directors and Staff harmless against any and all claims of whatever nature.

9) HEALTH:

It is the client's responsibility to ensure that he/she is medically fit and able to embark upon the tour. Anti-Malaria precautions should be commenced prior to departure and clients should bring insect repellent on tours.

10) PASSPORT & VISA:

The client must ensure that passport and visa are valid for the countries visited. Etosha Fly-In Safaris cc cannot and will not be held liable or responsible should a passenger be refused entry into any country for any reason.

11) BAGGAGE:

The baggage is limited to 20 kg per passenger unless a private aircraft is utilized for transport where the limit is 10 kg in one soft bag only unless otherwise stated.

12) PHOTOGRAPHY:

Etosha Fly-In Safaris cc reserves the right without giving further notice, to make use of any photographs or film produced by the company during any of their tours for general publicity purpose without payment or permission.

13) AIRPORT TAX:

For technical reasons it is not possible to include airport taxes in the tour prices. The passenger will be informed about the amount and should ensure that he/she has the money available in foreign currency at the time of departure from the country where airport tax is applicable.

14) AIRLINE CLAUSE:

The airlines or other carriers concerned are not to be held responsible for any accident, omission or event during the time that passengers are not on board their aircraft or conveyance. The passengers contract in use by the airlines concerned or by other carriers concerned when issued shall constitute the sole contract between the airlines and/or carriers and the purchaser of these tours and/or passengers. All tickets issued for air travel and accepted by clients show the applicable and agreed to contractual terms on the reverse side.

15) INSURANCE:

It is a condition of travel with Etosha Fly-In Safaris cc that all guests must have insurance for medical expenses, baggage loss, cancellation/curtailment, default and personal accident.

16) LIABILITY/RESPONSIBILITY:

The client should get him/herself acquainted with customary practices. Etosha Fly-In Safaris cc as well as co-operating agents do act only in the capacity of agents for the clients in all matters and and will under no circumstances whatsoever be responsible and be exempt from any liability for accidents, injury, delay, loss or damage to property or any other loss or damage from whatever it may arise. - All tours are subject to the conditions of the concerned airlines, hotels, restaurants and all other contractors involved.
